Anglian Water has been fined £1.6 million for repeated sewage pollution of the River Brain in Essex over a six-week period in 2022. The fine was imposed by District Judge Timothy King at Cambridge Magistrates' Court on October 15, following the company's failure to manage its water recycling operations effectively.

The Environment Agency charged Anglian Water with causing a discharge of untreated sewage into the River Brain outside of its environmental permit between April 13 and June 2, 2022. The prosecution was brought under regulations 12(1)(a), 38(1)(a), and 38(2) of the Environmental Permitting (England and Wales) Regulations 2016.

Pollution Details

The pollution incidents were traced back to Anglian Water’s water recycling centre in Braintree, where a faulty valve led to the discharge of semi-solid sludge into the river. The valve had been broken for a week before the first incident in April 2022. Despite alarms indicating the issue, Anglian Water staff failed to communicate effectively, resulting in the continued discharge of poorly-treated sewage.

The pollution affected nearly 14 kilometers of the River Brain, stretching between Braintree and Witham. Environment Agency monitors recorded the highest levels of toxic ammonia in the river over the past decade, indicating a significant decline in water quality.

Regulatory Response

The Environment Agency has increased its scrutiny of water companies, including Anglian Water, in recent years. In the 12 months leading up to March, the agency completed nearly 1,800 inspections of Anglian Water’s wastewater sites, identifying over 830 actions for improvement.

Marcus Sibley, the Environment Agency's water industry regulatory manager for East Anglia, emphasized the need for water companies to meet community standards and operate within legal boundaries. "These pollution incidents were the result of organisational failure by Anglian Water to recognise risk and act on the warning signs," he said.

Environment Secretary Dame Angela Eagle criticized Anglian Water for being too slow to act, stating that the environment had suffered as a result. She highlighted ongoing efforts to overhaul the water system, aiming for tougher regulation and greater accountability.

Additional Offenses

In addition to the River Brain pollution, Anglian Water has admitted to polluting the Thames Estuary on two occasions. The company pleaded guilty to discharging sewage and other harmful materials off Southend in 2021 and 2022. Sentencing for these offenses is scheduled for next April.

Water companies in England have faced more than 70 prosecutions by the Environment Agency since 2015, resulting in £169 million in fines. Anglian Water, classified as a two-star-performing company in the last environmental performance assessment, is among those held accountable for failing to meet environmental standards.
