These Terms of Service govern your access to and use of TradepilotUSA, including our website, software platform, dashboards, CRM tools, analytics, automation tools, billing features, AI features, communication tools, and related services.
1. Agreement to Terms
By accessing TradepilotUSA, creating an account, starting a trial, subscribing to a plan, or using any part of the platform, you agree to these Terms. If you do not agree, do not use TradepilotUSA.
2. Software Platform
TradepilotUSA provides business management software and automation tools that may include CRM, lead management, customer tracking, live visitor maps, website analytics, SEO automation, AI-powered workflows, invoicing, receipt processing, partner management, reporting, communication tools, website tools, and other business operations features.
3. Accounts and Security
You are responsible for maintaining the security of your account, passwords, users, connected tools, and login credentials. You are responsible for all activity that occurs under your account. TradepilotUSA is not responsible for losses caused by unauthorized access resulting from your failure to secure your account.
4. Subscriptions, Trials, and Billing
TradepilotUSA may offer weekly, biweekly, monthly, yearly, setup fee, usage-based, or custom billing plans. By subscribing, you authorize TradepilotUSA and our payment processor to charge your payment method automatically according to the selected plan until the subscription is canceled.
5. Free Trials
Some plans may include a free trial. Unless canceled before the trial ends, your payment method may be charged automatically when the trial expires. Trial length, eligibility, and included features may vary by plan.
6. Cancellation
You may cancel your subscription at any time through your account, billing portal, or by contacting TradepilotUSA. Cancellation stops future billing but does not automatically refund previous charges. Access may remain active until the end of the paid billing period.
7. Refund Policy
Unless required by law or approved by TradepilotUSA in writing, subscription fees, setup fees, usage fees, service fees, and other charges are non-refundable. If you believe a charge was made in error, contact us for review.
8. Customer Responsibilities
- Provide accurate business and billing information.
- Keep account login details secure.
- Review AI, automation, reports, messages, and outputs before relying on them.
- Maintain access to connected platforms and third-party tools.
- Use TradepilotUSA only for lawful business purposes.
9. AI and Automation Disclaimer
TradepilotUSA may use AI, automation, routing logic, generated content, predictions, summaries, recommendations, and workflow tools. These features are provided as business assistance tools. You remain responsible for reviewing, approving, verifying, and using all outputs. TradepilotUSA does not guarantee that AI or automation outputs will be accurate, complete, error-free, or suitable for every situation.
10. No Guarantee of Results
TradepilotUSA does not guarantee revenue, profits, leads, sales, search rankings, customer conversions, business growth, Google indexing, website traffic, or any specific business outcome.
11. Analytics and Tracking
TradepilotUSA may provide website analytics, live visitor tracking, lead source tracking, geographic tracking, page view data, customer behavior insights, and related reporting. Analytics may be affected by browser settings, device settings, third-party systems, privacy tools, ad blockers, platform limits, and data availability.
12. Third-Party Services
TradepilotUSA may connect with third-party services including payment processors, hosting providers, Google services, phone systems, email platforms, analytics tools, website platforms, databases, APIs, and communication tools. TradepilotUSA is not responsible for third-party outages, fees, data loss, access issues, policy changes, billing issues, or service interruptions.
13. Acceptable Use
You may not use TradepilotUSA for unlawful, abusive, fraudulent, misleading, harmful, spam-related, privacy-violating, or unauthorized activity. We may suspend or terminate access if your use violates these Terms, applicable law, third-party rules, or the rights of others.
14. Data and Privacy
Your use of TradepilotUSA is also governed by our Privacy Policy. By using the platform, you agree that TradepilotUSA may collect, process, store, and use information as described in the Privacy Policy.
15. Intellectual Property
TradepilotUSA, including its software, dashboards, designs, branding, workflows, code, layouts, systems, automation logic, documentation, and platform structure, is owned by TradepilotUSA or its licensors. You may not copy, resell, reverse engineer, duplicate, scrape, redistribute, or misuse the platform without written permission.
16. Customer Content
You retain ownership of business data, customer information, uploaded files, website content, documents, media, and materials submitted to TradepilotUSA. You grant TradepilotUSA a limited, non-exclusive, worldwide license to use, process, store, transmit, display, back up, analyze, and reproduce such information solely for the purpose of operating the platform, providing services, processing billing, maintaining security, complying with legal obligations, improving functionality, providing support, and delivering requested features.
17. Service Availability
TradepilotUSA works to provide reliable service, but we do not guarantee uninterrupted access. The platform may be unavailable due to maintenance, updates, outages, hosting issues, third-party failures, internet problems, security issues, or events outside our control.
18. Suspension or Termination
We may suspend or terminate your account if you fail to pay fees, violate these Terms, misuse the platform, create security risks, harm other users, violate third-party rules, or use TradepilotUSA in a way that may damage our business, systems, reputation, or legal compliance.
19. Warranty Disclaimer
TradepilotUSA is provided on an "as is" and "as available" basis. TradepilotUSA makes no warranties, express or implied, regarding the platform, software, services, analytics, AI outputs, automations, reports, integrations, uptime, availability, merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
20. Force Majeure
TradepilotUSA shall not be liable for delays, failures, outages, interruptions, data loss, or service disruptions caused by events beyond our reasonable control, including natural disasters, internet outages, cyberattacks, power failures, acts of government, labor disputes, third-party service failures, or other force majeure events.
21. Limitation of Liability
To the maximum extent permitted by law, TradepilotUSA will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost leads, lost rankings, lost data, business interruption, or loss of goodwill.
22. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on this page. Continued use of TradepilotUSA after updates means you accept the revised Terms.
23. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Texas without regard to conflict of law rules. Any dispute relating to TradepilotUSA shall be subject to the exclusive jurisdiction of courts located in Texas.
24. Dispute Resolution
To the fullest extent permitted by law, disputes relating to TradepilotUSA shall be resolved individually and not as part of any class action, consolidated action, or representative proceeding.
